On February 8 1949, he was sentenced to life inprisonment for treason against the Hungarian Communist government. His confession of guilt is believed to be a result of drugs and torture.

On February 12 1949, The Vatican (Pope Pius XII) announced the excommunication of all persons involved in the trial and conviction of Joseph Cardinal Mindszenty.
